These terms are an agreement between you and Sentrixa Systems Ltd. Please read them before using SameWay. If you do not agree with them, please do not use the service.
1. Who we are
SameWay is a trading name of Sentrixa Systems Ltd, registered in England & Wales, company number 17385810. You can reach us at info@same-way.co.uk.
2. What SameWay is — and what it is not
SameWay introduces people who are travelling the same way so they can share a journey. That is the whole of what we do.
We are not a taxi, private hire or transport company. We do not employ drivers, we do not own or operate any vehicles, and we do not carry passengers. When you offer or accept a seat, the arrangement is between you and the other member. We are not a party to it.
We do not check members’ identity documents, driving licences, insurance or vehicles, and we do not carry out background checks. Ratings, reports and the suspension rules below are there to help, but they are not a substitute for your own judgement about whether to travel with someone.
3. No money changes hands
SameWay is a community lift-sharing service. It is neighbours going the same way doing each other a good turn — not a way to earn money.
There are no payments on SameWay at all. There is no fare, no booking fee and no payment feature in the app. We never take, hold, process or refund money, and we do not expect or arrange any payment between members.
SameWay is not for paid journeys. Do not use it to charge for lifts, to run a transport business, or to advertise one. Carrying passengers for payment is “hire or reward”, which generally requires a private hire licence and different insurance — and it is not what this service is for. Accounts used this way will be closed.
SameWay is free to use and supported by advertising.
4. Who can use SameWay
You must be 18 or over. You must give accurate information when you sign up and keep your account details up to date. Your account is yours alone — do not share it or let anyone else use it.
5. If you drive
If you offer a ride, you are confirming that:
- you hold a valid driving licence for the vehicle and are legally entitled to drive it;
- the vehicle is roadworthy, taxed and holds a valid MOT where one is required;
- you have valid insurance for the vehicle. Because no money changes hands on SameWay, giving someone a lift is an ordinary social journey rather than “hire or reward”, and normal policies generally cover it — but it is your policy and your responsibility, so check if you are unsure;
- the details you give about your vehicle and the seats available are accurate;
- you will not drive if you are unfit to do so.
6. If you travel as a passenger
Turn up where and when you agreed, or cancel in good time so the driver can offer the seat to someone else. Treat the driver’s vehicle with care. Tell us if something goes wrong.
7. Community standards
SameWay only works if people can rely on each other. We ask that you:
- turn up. If you cannot make a journey, cancel as early as you can;
- be honest in your profile, your ride details and your ratings;
- treat people with respect. Harassment, discrimination, threats and abuse are not tolerated, in messages or in person;
- keep people safe. Do not drive dangerously or under the influence;
- respect privacy. Use another member’s contact details, location or trip information only for the journey you are sharing.
You must not use SameWay to advertise a commercial transport service, to sell anything, to collect other members’ data, or for anything unlawful.
8. Automatic suspensions, and your right to challenge them
Some suspensions are applied automatically, without a person reviewing them first. We set this out plainly because being suspended by a rule you had never been shown is not fair.
Your account is suspended for 7 days if, on our records, you reach any of these:
- 3 no-shows within a rolling 30 days;
- 5 late cancellations within a rolling 30 days;
- 3 reports from other members within 90 days.
We will tell you when this happens, and the message will say that the decision was made automatically.
You can ask a person to review it. Open Support in the app and choose Appeal suspension — this works while you are suspended. You have the right to human review of a decision made solely by automated means, to an explanation of it, and to contest it.
Separately from the automatic rules above, we may suspend or close an account where we believe someone has seriously broken these terms — for example threats, violence, or deliberately dangerous driving. We will tell you why, and you can appeal in the same way.
9. Ratings, reports and things you write
Ratings and comments you leave are about a real person and are visible to others. Keep them honest, relevant and civil. Do not post anything false, abusive, or that identifies someone beyond what the journey requires.
You keep ownership of what you write. You give us permission to store it and show it to the people it is meant for, so the service can work.
We may remove content that breaks these terms. If you believe a rating about you is unfair or untrue, you can challenge it — there is a route to do this from the rating itself in the app.
10. Safety features
SameWay includes live trip tracking, a share-your-trip link and an emergency button. These are there to help, but they depend on things outside our control — a working phone, a signal, battery, and location permission being granted.
They are not an emergency service and must never be relied on as one. If you are in danger, call 999.
11. Advertising
SameWay is free and carries advertising. Ads are provided by third parties, and what they collect is covered by our Privacy Policy and your consent choices.
12. Availability
We try to keep SameWay running and accurate, but we cannot promise it will always be available or free of faults. We may change, suspend or withdraw features, and we may update the app. Sometimes we will need to do this without notice.
13. Our responsibility to you
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law. Nothing here affects your rights as a consumer.
Subject to that: we are not responsible for what happens on a journey, or for the conduct of any member, because we are an introduction service and not the transport provider. We are not responsible for losses that were not reasonably foreseeable, or for losses arising from your own breach of these terms.
14. Ending your account
You can close your account at any time from the app. We may end your access if you seriously or repeatedly break these terms, and we will tell you why.
What happens to your data afterwards is set out in our Privacy Policy.
15. Changes to these terms
We may update these terms. If a change materially affects you, we will tell you in the app or by email before it takes effect. The date at the top shows when they were last reviewed.
16. Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live elsewhere in the UK, you may bring proceedings in your own country’s courts.
